"TOC TOC KIDS RAFFLE IN COLLABORATION WITH IMAD "

1. DESCRIPTION OF THE ACTION

TOC TOC, S.C.P., with address at Calle Madrid 1 - 43870 Amposta (Tarragona), and CIF J55625396 (hereinafter TOC TOC Kids) and INSTITUT MEDIC PEREZ BARBERA SLP, with address at Calle Valletes 4 Bjos - 43870 Amposta (Tarragona), and CIF B55679781 (hereinafter IMAD), organize a promotional action consisting of a raffle aimed at IMAD's clients who perform a 5D ultrasound to publicize the service of children's room projects, IMAD), organize a promotional action consisting of a raffle aimed at IMAD's customers who perform a 5D ultrasound to publicize the service of 3D children's room projects in TOC TOC Kids (hereinafter, IMAD)www.toctockids.com) and consisting of offering the opportunity to obtain by means of a raffle mechanism:

• A total of ONE (1) 3D PROJECT FOR A CHILDREN'S ROOM each month during the promotional period, all in accordance with the requirements detailed in these Rules.

Hereinafter referred to as the Promotion.

2. GEOGRAPHIC SCOPE

The territorial scope of the Promotion will be the Spanish territory.

3. PERSONS TO WHOM THIS PROMOTION IS ADDRESSED

This Promotion is only aimed at private individuals residing in Spain, with a minimum age of 18 years old, who are customers who have undergone an ultrasound at IMAD, with the exception of the employees of the companies organizing the Promotion, suppliers, direct or indirect collaborators who have participated in the elaboration or printing of the components of the same, nor the direct relatives of all of them.

4. PROMOTIONAL PERIOD

Those customers who have performed an ultrasound at IMAD and filled out a participation card during the period from March 1 to December 31, 2018, both dates inclusive, and comply with the provisions of these Terms and Conditions, will participate in this Promotion.

5. PROMOTION DIFFUSION

TOC TOC Kids and IMAD will communicate the Promotion through the following means, including but not limited to:

i) the web pagewww.toctockids.comAnd its own resources;

ii) the web pagewww.institutimad.comAnd its own resources;

6. AWARDS

In exchange for the completion of ONE (1) 5D SCAN AT IMAD, customers will be entered into a drawing for one of TEN (10) prizes, i.e. one prize each month, of ONE (1) 3D PROJECT FOR A CHILDREN'S ROOM each month during the promotional period.

Prizes may not be assigned to third parties.

The prize will not be subject to change at the request of the participants in the Promotion. The enjoyment of the prize will be personal and non-transferable, being expressly prohibited the commercialization of the prize.

TOC TOC Kids and IMAD reserve the right to modify the prize for others of similar characteristics or value.

Only ONE (1) participation per person (identified by their DNI or NIE) is allowed. In the event that the same participant participates more than once, he/she will be excluded from the Promotion.

Hereinafter referred to as the Award.

7. MECHANICS OF THE PROMOTION SWEEPSTAKES

7.1.- REGISTRATION

During the promotional period, customers, over eighteen (18) years of age and residing in the Spanish Territory, who are interested in participating in this Promotion, must:

1. Request a visit to IMAD for a 5d ultrasound.

2. On the day of the visit, ask for a raffle participation card and fill in your personal information, marked as mandatory, required to participate in the Promotion.

3. The card must be given to a member of the IMAD team.

7.2.- DETERMINATION OF THE WINNERS

The Promotion Prizes will be obtained by drawing lots:

At the end of the current month, TOC TOC Kids will randomly select 1 winner from all valid entries received between the 1st and the last day of the previous month

AWARDS.

In the event that the number of participants in this Promotion is less than the number of prizes, the remaining prizes will be considered void for all purposes.

8. TERMS AND CONDITIONS OF THE AWARD

Prize acceptance will be handled by TOC TOC Kids. TOC TOC Kids will contact each winner by email to redeem the Prize. If after several attempts it is not possible to contact the winner before the end of the current month, it will be understood for all purposes that the winner renounces the Prize, thus declaring the Prize void.

The waiver of the Prize shall not entitle the winner to any indemnity or compensation whatsoever.

The effective delivery of the Prize will be conditioned to the winner's compliance with the conditions specified in these rules and the veracity of the data provided to TOC TOC Kids and IMAD.

9. TAX REGIME

The prizes object of this promotion are not subject to withholding or payment on account of Personal Income Tax (IRPF) in accordance with article 75.3.f) of Royal Decree 439/2007, which approves the IRPF Regulations, as their withholding base is less than €301.

10.- RESPONSIBILITY OF THE ORGANIZING COMPANY

Without limiting in any way the rights recognized to customers in the applicable provisions, TOC TOC Kids and IMAD exclude any liability for damages of any nature that may be due to the temporary lack of availability or continuity of the operation of the Website or technical problems or of any other nature that cannot be attributed directly and negligently to the latter. Notwithstanding the foregoing, TOC TOC Kids and IMAD will ensure the correct availability and continuity of the operation of each of its Websites, through which information on the Promotion is accessed.

TOC TOC Kids and IMAD are not responsible for the use that the winner makes of the Prize or for the services that third party companies must provide on the occasion of this Promotion.

TOC TOC Kids and IMAD are not responsible for any problems or subsequent delivery of the Prize.

11. PROTECTION OF PERSONAL DATA

The personal data requested in the framework of the present Promotion are mandatory in order to participate in the Promotion (among others: to manage the registration in the Promotion, the delivery of the prize in case of winning, to solve doubts about the Prize, to solve incidences and to communicate promotional information of TOC TOC Kids and IMAD).

The data provided will be treated with the utmost confidentiality and in accordance with current legislation on personal data protection, respecting the security measures in accordance with the security level of the data provided at all times. The data provided will be treated with the only purpose informed in the informative phrase of personal data protection.

Participants may exercise their rights of information, access, rectification, opposition and cancellation of personal data at any time by sending an email to the following address indicating the word "LOPD" in the subject of the message: [email protected].

In the event that the participant has received commercial communications through electronic means (e.g. e-mails), he/she may request to unsubscribe from the sending of such commercial communications by electronic means through the option enabled at the bottom of the communications received, by clicking on the section CLICK HERE, to unsubscribe.

13. USE OF THE WINNER'S IMAGES AND/OR RECORDINGS

Participants authorize TOC TOC Kids and IMAD to peacefully use the images and/or writings obtained within the framework of this Promotion, including the image, name and writing, without territorial limitation, both in any publi-promotional activity related to the Promotion in which they have participated and for the purpose of reporting on the result of this Promotion in the media that TOC TOC Kids and IMAD deem appropriate (including, but not limited to, press, radio, television or internet). In no case may it be understood that such use confers the participant the right to any remuneration or benefit whatsoever, with the exception of the delivery of the prize won in accordance with these rules. Likewise, he/she grants the rights for his/her images to be used for the promotion and advertising of the next editions of this Promotion.

14. UNFORESEEN AND EXCEPTIONAL EVENTS

TOC TOC Kids and IMAD reserve the right to cancel, extend, shorten or modify the Promotion if circumstances force them to do so, without having to justify the decision and without being able to claim any type of responsibility as a consequence, always in a way that does not prejudice the rights acquired by the participants.

The organizing companies reserve the right to eliminate from the Promotion for justified cause any consumer who defrauds, alters or renders useless the proper functioning and the normal and regulatory course of the Promotion.

To ensure and control the veracity of the participations in the Promotion, in the event that TOC TOC Kids and IMAD detect any anomaly in the registration or determination of the winner, it will be entitled to request additional information or documentation, being the participant's responsibility to keep them for this purpose, even after the end of the Promotion.

15. INQUIRIES AND INFORMATION

The conditions of participation in this Promotion will be posted on the Web sitewww.toctockids.comDuring the entire period of participation.

For any additional information about the Promotion, the participant will have at his/her disposal the telephone number 977 460 389, which appears in the publicity of this Promotion.

16. APPLICATION OF THE BASES

The mere participation in this promotion implies acceptance of these Terms and Conditions. In case of possible doubts in the interpretation of these Rules, the criteria of TOC TOC Kids and IMAD will prevail.

These Rules will be available to all participants, at Calle Madrid 1, 43870 Amposta (Tarragona).

Participation in the Promotion is free of charge. However, in order to obtain the Prize, an initial 5D ultrasound scan at IMAD is required.

17. CONFLICTS AND APPLICABLE LAW

These terms and conditions are governed by Spanish Law.

Failure to comply with any of the rules by the participant will result in immediate elimination.

Participants and the organizing company agree that any disputes that may arise in the interpretation or execution of these rules shall be subject to the jurisdiction of the courts and tribunals of Tarragona Capital.
